Xavier Becerra, the Attorney General of California, announced an $800,000 settlement against Infosys and its BPM (business process management) unit in December 2019.
According to an official article on the State of California website, between 2006 and 2017, over 500 Infosys employees worked in the state on Infosys-sponsored B-1 visas rather than H-1B visas.
Because of this misclassification, Infosys avoided California payroll taxes including unemployment insurance, disability insurance, and employment training taxes.
In 2011, Infosys was charged with visa fraud for exploiting B-1 tourist visas for tasks that required H-1B work permits. An American Infosys employee first made the claims in an internal complaint.
He then sued the corporation, saying that he was harassed and demoted as a result of coming out. Although the lawsuit was dropped, it brought the claims to the attention of US authorities, and the US Department of Homeland Security and a federal grand jury began investigating.
